1. Subject of the contract

transfer.tuscanyall.com is owned by TuscanyAll.com srl a limited liability company registered in Italy with VAT registration number 05511100488 with head office in via di Scandicci, 22R, 50143 Florence, Italy.

These general conditions shall govern the contractual relationship between transfer.tuscanyall.com, (or “Transfer in Italy”) and the customer (you), under which TuscanyAll acts as the declared agent of the supplier.

We cooperate with private transport operators (or ‘Suppliers’) for the provision of our services. Suppliers are professionals in the transport sector and offer passenger transfer services. In addition, they may act as agencies that have the legal capacity to offer transport services. The Suppliers are in possession of all the necessary licences and permits according to the legislation applicable in Italy, in order to carry out this activity of booking transfers.

The following terms and conditions apply to contracts concluded between the website and the customer:

By making a reservation on our website, you agree that a contract for the use and provision of the service is between you and our service provider. Where the booking is made by an agency or any other person acting on your behalf, that person is deemed to be acting as an agent for all passengers using the service, including yourself. You agree to be bound by these terms and conditions and all other information on the website.

By making a booking, you confirm that you have read these Terms and Conditions and that you have the legal capacity to accept them both on your behalf and on behalf of all passengers who will use the services.

Please note that these general conditions are subject to change without notice, and any changes will be communicated by e-mail, our app, our website or by other means provided for this purpose.

2. The booking process: payment and contract

Reservations can be made through our website. Where a booking is made for more than one person, the person making the booking (“the booker”) is deemed to be acting on behalf of all the passengers involved and accepts the following terms and conditions on behalf of each passenger involved. The booking party must be at least 18 years of age.

During the booking process, payment of the full amount is required. Upon receipt of full payment, Transfer in Italy will proceed with processing the booking. A confirmation will then be sent to the booker containing details of the transfer services booked. The email represents the “ticket” and must be presented to the supplier’s representative or driver.

Once the booking is confirmed, a legally binding contract will be established between the booker (and all passengers listed in the booking) and the supplier. However, this contract will not be binding until full payment has been received. Therefore, we cannot assume any liability for the services requested if full payment has not been made.

In the event of a complaint regarding unsatisfactory service, both Transfer in Italy and the supplier may consider reimbursing you for the relevant expenses incurred in reaching your destination. You will need to provide all supporting documentation relating to the expenses incurred.

Transfer in Italy or its suppliers cannot be held responsible for the timeliness, accuracy or quality of services due to incorrect information provided at the time of booking the service. It is the responsibility of the principal client (or their agent) to check the accuracy of all booking details prior to travel and to notify Transfer in Italy promptly of any errors or discrepancies.

If there is an error in the information provided at the time of booking that results in a change in the cost of the services, the client will be liable for such additional costs. In the event that it is not possible to pay the difference due to incorrect information provided by the client, Transfer in Italy or the supplier reserves the right to cancel the services without any obligation of compensation or refund to the client.

The supplier’s price indicated on our website is the final price and no additional costs will be charged if the information provided at the time of booking is correct.

3. Child seats

It is important to be aware of local legislation when travelling with children. As a customer, you are responsible for correctly providing all passenger information at the time of booking and, in the case of travelling with children, you must select the necessary extras if required. Please note that in some cases the use of child seats may incur additional costs, which must be paid at the time of booking.

It is the responsibility of the booker to ensure that the retention system (child seat) is compatible with the vehicle and that it is installed correctly. Neither Transfer in Italy nor our suppliers will be liable for any accidents resulting from the misuse or incorrect installation of the restraint system.

In some cases, the use of child seats or child lifts provided by the customer may be permitted. You must inform us in advance at the time of booking if you wish to use your own restraint system. However, we would like to point out that we must ensure the compatibility of the restraint system with the vehicle used by the supplier. In some situations, such as when travelling with large groups in minibuses or coaches, it may not be possible to use child seats, as such vehicles may not be equipped for this purpose.

We will make every effort to ensure that the supplier provides the required extras, such as child seats, at the time of booking. However, in the event of unavailability, you will be reimbursed the cost of the extra child seats. If the booked restraint systems are not available, children over the age of three must use a seatbelt. Children under the age of three may travel without a restraint system, but will be required to be placed in the rear seats of the vehicle.

4. Prices for children

To ensure safety and compliance with vehicle capacity standards, it is important to consider all children and infants, regardless of their age, as full passengers and include them in the total number of passengers when booking.

5. Passengers with disabilities

In some destinations, Transfer in Italy works with its suppliers to offer transport services for people with disabilities or reduced mobility. If you would like to book a vehicle with such characteristics, we encourage you to contact our customer service department prior to booking. Therefore, we encourage you to contact us in advance so that we can provide you with personalised assistance in choosing the most appropriate vehicle.

6. Modifications

You can make changes to your booking up to 72 hours before using the confirmed service subject to availability. If you wish to make changes to your booking less than 72 hours before using the service, please contact us directly by sending an email to transfer.tuscanyall.com using the email address provided at the time of booking. Please make sure to include the booking reference number, the name of the booking passenger and the requested changes.

However, please note that changes made may incur additional costs. It will be necessary to pay these costs before making the requested changes.

In general, and for most services, we do not charge for changes or amendments to the booking, although we reserve the right to do so if the change increases the price of the original booking.

7. Cancellations

To cancel your booking, you can use our website or send an email to transfer.tuscanyall.com. If you decide to cancel your booking at least 72 hours before the date on which you will use the confirmed service, you will be fully refunded.
If you cancel your booking less than 72 hours before the date on which you will use the confirmed service, there will be no refund.
In the event that the booked services are not used for any reason without a cancellation having been made, no refund will be given. Any refunds will be credited to the original form of payment and account used at the time of booking.

7.1 Cancellations on our part
In the event of exceptional circumstances where our provider has to make significant changes to the confirmed terms of service or cancel the service, we will endeavour to find viable alternatives for any confirmed booking we have to cancel. If, despite our best efforts, we are forced to cancel your booking, you will be refunded the full amount paid for the booking. This refund will cover all obligations to the customer arising from such cancellation.

8. Booked vehicles

We strive to accommodate our customers’ preferences regarding vehicle choice. However, should the need arise, we may have to replace the vehicle booked with one of a higher capacity or more vehicles, depending on availability. In the event that such a change results in a reduction in the category or size of the vehicle, and in the event that we have a cheaper rate available for the new vehicle, you will be refunded the difference in price.
All vehicles provided by our suppliers are covered by comprehensive insurance that meets the legal requirements for passenger and third party damage as stipulated by local law.

9. Luggage

Vehicles used for private transfers are equipped with a luggage compartment with a capacity of 1 suitcase per passenger, provided that it does not exceed the maximum weight of 23 kg/50 lb. It is important to inform us at the time of booking about the size and quantity of luggage to be carried. It is not necessary to declare smaller items such as cameras, bags or small backpacks. However, should it become necessary to use additional vehicles to transport undeclared luggage (subject to availability of vehicles), the passenger will be responsible for the additional costs incurred.

In accordance with the legislation of the country in which the service is provided, it is forbidden to include in your luggage or personal items that are against the law (such as firearms, etc.) or that may pose a danger to others. Animals are permitted as long as they are guide dogs or travel in a pet carrier.Please avoid carrying objects of excessive size, weight, maturity or fragility.

The carriage of your luggage and other personal belongings is at your own risk. Neither Transfer in Italy nor our suppliers will be liable for any damage or loss that may occur during transportation.You are advised to exercise caution and take precautions to protect your personal belongings during your journey.

10. Private Transfers

Although we do our best to ensure compliance with departure and arrival times, we cannot guarantee an exact route to your destination. All information provided on our website, including details of route maps, is for information purposes only. Various factors, such as unforeseen road traffic or adverse weather conditions, may affect the route and travel time.

If you cannot find the driver, please contact the supplier immediately. The telephone number of the supplier is indicated on the transfer voucher. Should you organise alternative transport without informing us, the supplier will be released from its obligation to provide the service and no refund will be made.

In the event that your private transfer driver is unable to reach you, he will attempt to contact you on the mobile phone number provided during the booking process. Please ensure that you travel with that mobile phone and that it is switched on. In the event that the driver is unable to reach you on the number provided and communication cannot be established, this will prevent the service from being provided and no refund will be made.

Unused transfers are not eligible for reimbursement, and costs incurred for alternative transport will only be reimbursed if authorised in advance by a member of our team. If you are authorised to book alternative transport, please obtain a receipt and submit it for our verification. Please note that transport costs related to reimbursement requests without valid receipts will not be reimbursed.

The service provider will do its best to pick you up and drop you off as close as possible to the directions provided. However, in the event that access via the regular route is closed due to adverse weather conditions, traffic accidents or other unforeseen circumstances, the provider will, upon your explicit request, seek an alternative route to the agreed destination. Please note that in such cases additional costs may arise for you.

At certain destinations or due to road works or other circumstances, it may be necessary for you to be dropped off or picked up at a central point within a reasonable walking distance from your final destination.

In the event that your flight or train arrives late, our provider will monitor your arrival up to a maximum of 2 hours after the time confirmed in your booking. You must therefore indicate the flight or train number on which you are travelling.

Upon landing, docking or arrival of the train, the driver will wait for you for a maximum of 1 hour in the case of a flight and 30 minutes in the case of a ship or train.

All contracted transport services are covered by the liability policy of the supplier or the company subcontracted by the supplier.

11. Your responsibility

By formalising this contract, it is implicitly stated that:

  1. I confirm that I am over 18 years of age and am in full possession of my mental faculties. I am able to assume the legal responsibilities arising from this contract and am fully aware of the services that are the subject of the contract, the information concerning the company and the content of these General Terms and Conditions.
  2. You declare that the credit or debit cards used to make the reservation are your own and have sufficient funds to cover the full amount of the reservation.
  3. The user is aware of the obligation to promptly notify any changes to the data provided.
  4. The customer is obliged to provide the necessary documentation for border crossings. We accept no liability and refuse to incur any additional costs resulting from failure to provide such documents or failure to comply with customs, police, tax or administrative regulations of the destination countries. It is important to note that our voucher does not constitute a valid document for obtaining an entry visa.
  5. It is the customer’s responsibility to check the scheduled time of departure and arrival and to ensure that he/she arrives at the airport, station or port with sufficient time to check-in.

The services will be provided on the basis of the information provided and transmitted by e-mail. The user is obliged to provide complete and correct information on the pick-up and destination points at the time of booking. It is also the responsibility of the customer to print and verify the accuracy of the transfer voucher. In the event that the information on the voucher is incorrect, you must immediately contact our Customer Service Department to request a correction.

We accept no responsibility for bookings that cannot be made due to insufficient or incorrect information provided by the user, and no refund will be made for such bookings.

In the event that Transfer in Italy or our supplier is required to pay a deposit or fine to the authorities of other countries as a result of your failure to comply with the laws, regulations or other requirements of the countries you intend to enter, leave or pass through, you accept full responsibility for reimbursing Transfer in Italy or our supplier. You hereby authorise Transfer in Italy to charge your credit or debit card for any fines or damages incurred by the transfer vehicle (including special cleaning) or any items missing from our supplier’s vehicle.

We reserve the right not to accept further bookings from a customer who has repeatedly caused one or more serious accidents.

12. Our responsibility

In the event of a breach of these conditions, we shall only be liable for damage or loss directly attributable to our non-performance or negligence, and up to a maximum of the total amount paid by the customer. We shall not be liable for damage not directly attributable to us, nor for damage caused by accident, force majeure or legal or administrative requirements.

We cannot be held liable if the performance of our obligations or those of the transport operator is prevented or affected directly or indirectly by a force majeure event or any circumstances beyond our control. These circumstances may include, but are not limited to, extreme weather events, natural disasters, acts of terrorism, accidents caused by third parties along the transfer route, police checks, extraordinary traffic congestion or strikes.

Transfer in Italy reserves the right to refuse any booking made by the customer and cannot guarantee the allocation of a supplier for every booking made with us.

Unless it can be shown that we have breached our duty to select transfer service providers with reasonable skill and care and that, as a result, you have suffered loss or direct damage, we have no liability to you for the actual provision of services.

We are not liable for accidents occurring during the provision of the service, unless they are directly caused by our negligence.

In accordance with these conditions, we may assume liability if, for example, damage occurs to the passenger or if the transport service is not provided as per contract or is provided inadequately due to our inability or the inability of our employees or transport operators to provide the hired transport service using reasonable knowledge and professionalism.

13. Complaints

If the service you receive from our partner (the supplier) does not meet your expectations, you should inform our Customer Service immediately and, when possible, do so at the time the incident occurs. You should first contact the local supplier directly using the number provided in your booking confirmation so that they can help you resolve any issues. The supplier’s contact details can be found on your booking confirmation voucher.
Written complaints should be emailed to transfers@tuscanyall.com within 28 days of the return date.

14. Passenger Conduct

By formalising this contract, the company and the supplier are tacitly granted the right to refuse service to any passenger who, according to the driver’s criteria, is:

  1. Under the influence of alcohol or drugs.
  2. Whose conduct can be considered dangerous to the driver of the vehicle, to third parties or to themselves.

It is specified that alcoholic beverages are not permitted in the supplier’s vehicles for consumption during the journey. This prohibition also extends to narcotics.
Furthermore, it is emphasised that smoking or eating is not permitted inside the vehicle.

15. Jurisdiction

These General Terms and Conditions shall be governed by the Italian legislation in force. The contract agreed between you and Transfer in Italy shall be governed in accordance with Italian law. Any disputes or claims arising out of these terms and conditions shall be subject to the exclusive jurisdiction of the Italian courts.

If any of the provisions contained in these terms of use are declared illegal, void or unenforceable by a court decision, the rest of the provisions shall continue in full force and effect.

16. Privacy

The Online Privacy Policy has been developed to confirm our commitment to the information we collect from users on transfer.tuscanyall.com. This policy covers the processing of information provided by you in order to identify you, whether that information is collected directly on the website or through other means such as customer service or telephone calls.
